Norm small claims court doesn't mean you'll get your money back either. Dad tried to buy an OD tranny from a guy in N MN. Never got it. Finally took a day off work to go to court. I think he ended up having to go to duluth. Guy was a no show in court so of course he lost the case. The court clerk when filing a lein against him said "oh this guy again he does this all the time" Apparently when he gets too many he lets his property default to the bank and no one ever gets paid back.

I once took someone to small claims court over a traffic accident. I clearly won but the person would not pay. Because this was a traffic-related claim I then filed claim with the licensing department. When and if this person had to renew a driver’s license they could not do so until I was paid. About a year later I got paid. A couple days later I got a phone call wanting me to sign a waver stating that the person had paid the debt. I told the caller no I will not sign a waver but they can contact me in a year so they can wait as long as I did to collect what I was owed. I never heard from them again.

I have read with interest the problems some are having with you about not paying or refusing a refund to a customer . As I understand it both parties dealt with you in good faith and for whatever reason you have declined to refund one's money and to pay the other for goods he shipped to you . Both are acquaintances of mine and I really think you have abused both them and the P-15/D24 site. You seem to have taken advantage of the boards good auspices and now take advantage of your poor heath as an excuse.

On Colorado's front range, an $185K house is a pretty modest home. I would guess it is a two bedroom rambler judging by the photos of his vehicles that Robin found. Still, it's not too much trouble to lick a stamp, esp. since it is actually being sent to Robin's friend in Cali. I doubt the utility company would be so understanding if he failed to pay his utility bill for two months. It all can go in the same mailbox.

I have to go with my gut and my gut is saying this is going a bit too far, I mean when you get right down to it, we have all lost some cash...or alot of cash...over the years, and while it's a real pissoff, it's not the end of the world.

I'm just thinking making personal information public on a website could be do more damage than is really intended and not in keeping with the spirit of this great forum.

Been following this mess and I myself think that we have done enough in this case. At the present time I think we should let it rest and in a few weeks or so maybe continue on with this problem. I have been very fortunate to have never had any problems here on this board and really have gained alot of information on various subjects. As I said if the party does not get back with some reasonable reason that he does not have the cash than he should just set aside a portion of the owing amount and send that to our friend in England as month payments. Maybe we all could just dig into our pockets and give our European friend a small amount cash as a jester of what America is all about and that is unity and trust. Jon

I'll agree that if what you say about someone is true, it is not slander. However, isn't it also true that if that person wanted to he could still sue you for slander. He may not win his case against you, but.........you'd still have to pay for the defense of what you said if he did sue you for slander. Agreed, you would probably win the case against you for slander. Then you may be able to turn around and sue him for all your court cost since he lost the case. However, that could be a real pain since you have to keep going back to court so many times for the same thing.

I have to agree w/ Norm on his opinion. Yes, telling the truth is not slander, but one still may have to at least invest the time into defending oneself in court. I ran afoul of a local business here in Loveland that I still feel took advantage of me (and probably just about everyone else that's done business w/ them).

After pleading my case to the franchise that bears their name and the BBB w/ no results, I began contacting the businesses in close proximity and soon received a letter from his lawyer threatening a lawsuit if I did not cease and desist. My next step was to tell his neighbours near his home what a cheat he is. I didn't go that far because I could not afford to defend myself in court.

Greg, I can tell you first hand she knows whats going on. She sent me harsh e-mails that insinuated I was the bad guy for pressuring Rodger and I should leave him alone. I think this is going nowhere, sorry to say. We should just move on for now like I did. Richie.

If you look at the dates, I realized I had the 800 series radio after the original date of saying I had an radio. At first I thought it was the 600 series radio that I had, until I saw the bold writing on it. As soon as I realized I had the 800 series I went to the site and asked what was the difference as you can see. I also informed Robin that I had the 800 series.

I have always been as honest, up front or good to people as I can.

I also believe that we have met during a Denver WPC Event. Either way, I feel as if I have should of stopped all of this when he wanted to offer an lessor amount for the radio that what I have repaired it for.

I live here in Colo Spgs and now work on U.S. Hwy 40 between MM 445 and 435 ( this is between Kit Carson and Wild Horse ). If anything goes wrong while I am there on my shift, I stay there until all is well. My shifts are twelve hours each day.

I just read all the sagga of this and see I am now marked as a scum-bag. In last April, three years ago I had an massive stroke and spent 12 days in the IC Ward here in the Colo Spgs Hospital. After that they had me in the Stroke Re-Hab Ward for almost three months. Some parts during this time I needed my wife to help me out with what I was doing and etc. I still rely on her for "blank periods" that may have happened in the last 3 1/2 years during that period.

The radio was packaged to send to Robin, taken out to make a scan of the face plate, re-packaged to send to Robin, then asked to hold on to it to send to another. Then he decided that he now wanted to have his funds back.

During the same times I went to work and would send him the info that he was asking for when I got back home ( no TV, P15-D24 Site or what-ever in Kit Carson while there ). I also went to our niece's funneral in Barstow during all of this.

If you would like the original emails to look over, please let me know since my wife wanted me to keep them as I making them with Robin. Even though I do not know the person by the name of "Richie", I will contact him.

It's great to know that you're on my side.... To be honest, I never doubted that for a moment.

However, I also think some of the comments may be a bit strong, and possibly too personal.

Whilst I would be the first to want to seek justice, I think any threats to property or person, or implicating family members in this business is going a bit far.

Rodger identified himself in the earlier thread, so his identity was no secret.

I have posted his user name, email and picture, purely in order to help others avoid getting into a similar predicament or, if they choose to deal with him, to do so in the full knowledge of what has gone before.

I think everything's been said but if i do receive payment, or hear anything else from Rodger, I will keep you posted.

In the meantime, let's all get back to the business of enjoying our great cars!
