plymouthtomas Posted September 21, 2012 Report Posted September 21, 2012 Hello Everyone On 9/10/2012 I was in a automotive accident, police report says the school bus ran a red light going about 40mph, 6 cars were hit by the bus, The school bus insurance company is saying that the bus driver stating the light was green, the police report has 4 witness that were not involve in the wreck at all saying the light was red. The bus driver statment is not on the police report, they will not pay for my car to be repair, it was hit in the front and back.They want my insurance company to pay for my car to be repair, Boy did that piss me off So I start calling people way the corp ladder and the school board reps Anybody have any ideals what do next ??? thanks Eddie Quote

desoto1939 Posted September 21, 2012 Report Posted September 21, 2012 Call your ins carrier to report the accident. Assuming your car can not be driven and it was taken to a site. Your adjuster will look at the car and determine a price to fix. You pay the deductable. Then they fight out the cliam with the other school bus drivers ins carrier. They determine who is at fault. If them then the refund your deductable back to you. Get acopy of the police report and also let your ins carrier know the policy report number. If the bus went throught a green light and then hit the other cars he still has to have control of his bus. Sure they are going to deny responsibility. to get out of the claim. dezeldoc Posted September 21, 2012 Report Posted September 21, 2012 First thing call a lawyer that is the way it is dealt with. If you try and handle it yourself you will get nothing. These days nobody wants to take responsibility for their actions and will deny it. It is a sad state when you have all the proof and you still have to fight like it is your last meal. Your ins will still not work for you just for their interests to avoid spending any money. Good luck with it and i hope they make it right. Quote
Big_John Posted September 21, 2012 Report Posted September 21, 2012 If you have collision insurance, get the car fixed and let the insurance companies fight it out. Hiring a good lawyer (emphasis on good) will cost $$. You already pay insurance premiums in case this happens. Quote

Tom Skinner Posted September 21, 2012 Report Posted September 21, 2012 Eddie, I would say the officer filling out the report was a schlepp. He had credible multiple eyewitnesses stating the bus ran the red light and didn't put that on the report? What a d _ _ k Wad. Those government empoloyees stick together. By that I mean Cops & School employees/bus drivers etc. They pretend to work and we pretend to pay them. Nonetheless, go see a laywer and get some letters out. They will ante up once they see you mean business. Probably not until then. Too bad our system doesn't seem to work for honest people anymore. Yea, I know that is true, but I went through this myself (I was hit by a off duty cop) and discovered that the lawyer bills would cut into the settlement to the point of where it wasn't worth it. That is if I even got a settlement..... Lesson learned for me... collision insurance on everything I can't afford to just walk away from. I went through this again, not my fault, but no witnesses and his word against mine. I got my OT car fixed, paid the deductible, let the insurance company argue it out and in a couple weeks got a check for the deductible. Believe me, I understand some things have to be done with lawyers... but I really think it's the last thing you want to do in a lot of cases. Quote

My 2 boys and I was hit by a cops kid and his dad showed up and had his buddy fill out the report and guess what ...all the witness info was incorrect, the "mystery" car that was supposedly involved was at fault. Long story short took it in the shorts but at least the lawyer got my kids car paid for which they were not going to pay for. I argued with both insurance co's and provided 100% proof he was at fault but they did not want to get into the expense of fighting it. needless to say the kid dropped his insurance with progressive after that!
