Yes, you are correct. We too can do leins here in California and that is one of the ways that a person can obtain ownership. But it is a proceedure and must be followed in order to obtain title. We do it often in my shop. But until I have actual title of said vehicle I am in no way allowed to sell it. That is where the salvage seems to have company messed up. I would venture to guess that they didn't figure that the vehicle would still be in the DMV system. If a vehicle has dropped off of the system there might have been a chance that a bill of sale would be accepted, being as many states did not title vehicles "way back when". But this one did turn up in the system and that is something that a seller must know.

Well......guess I'll add my 2 cents worth here, which is probably only worth zero.

First of all I just want to say I would not touch a car with a ten foot pole without seeing a clear title from the state, regardless of how old the car is or who's selling it.

That said. If I were to find myself in a situation like this, I'd be back at the sellers door. I would simply say, "Look, you sold me a vehicle that did not have a clear title and has a lien against it." "Either, you get me a clear title within a set number of days or, take the car back and give me my money back." If the seller refused I would simply say. "Ok, I'll see you in court" and start heading out the door. If no response from him before I got to my car I would head straight to my attorney's office and start legal proceedings. Remember, in many cases like this you can also sue for all legal expenses, including the actual amount of loss. So really, you don't lose anything if you win. A good attorney will also tell you up front what your chances of winning are.

You can always find another vehicle similar to the one you bought, maybe better.

I must say I bought both my 46 & 48 without titles. They were both projects that had never been registered for a title. I've also bought a p15 parts car and a dakota parts car with no titles but those were just scrapped so no big deal.

Norm...never but never entertain getting an old car from Georgia..there is no title..even if you have one moving into this state they WILL NOT issue a title in Georgia...and as far as the 40's vehicles..if was sold in Georgia originally..it has NEVER had a title...further if you got the car from the second owner and went to the first owner to get the title and he did in fact give it to you, it is of no value here because when the second owner registered the car then the chain was broken...it can be very frustrating...however for taking the car out of state...the bill of sale is all that is needed..but for good measure it is best to have a copy of the registration card had the PO registered the car in his name. The title would be of little value except to say you know there is no lien or other claim against the car. All states issuing a title will do so because of Georgia law...it is not really a problem..just at times a nuisance.

I WON! here is the story, I call the owner of the company with the lien three days in a row, He said He'd call me back tomorrow, every single day...then today He told me He did not have time for this, to just go over and settle it like man............. with a 20 pack of my choice...There I go 40 miles out of my way from work with the finest brewskys I could find at the local liquor store...I get there and four of his best sales guys are there waiting for me, He opened the first bottle and tells us the story on how He got the car (story is too good for this thread stay tuned...) and how it use to look like. then some talk about general business ideas and ethics of his business, then after I mention my side of the story, He agrees that I will have to part the car out to get my money back, and Him seeing the pictures of the car, He told me, a lot people have tried to get the title just to sell it and make a quick buck, you seem to care for this junk(P.O.S.) I telll ya I will just sign it if you can promise me that you will finish it. Isaid YES SIR! He signed it stamp it and gave me a typed letter stating that the interested in the car has been dropped and that the lien hold has been satisfied, "PAID IN FULL"

The sweetest words coming from this old timer with a raspy voice and a mean look. We completed the transaction with the last beers and a firm hand shake, I tell ya, I have a better understanding about ethics and conduct of business, as it "use to be":D
